They didn't confess to rape. The police are saying that her blood alcohol level showed that she was too drunk to consent to sex therefore that is rape.
It is not as cut and dried as the right wingers in this thread think. There are a lot of questions here, like at what point was she to drunk to consent to sex? When did they actually have sex with her (before after after she drunk)? Was she drunk when she left the bar or did she get drunker in the car or at other bars? Were the guys drunk too? What kind of rapists willingly drop a victim off when and where she wants to dropped off?

BATON ROUGE, La. (WAFB) - Newly-obtained video shows LSU student Madison Brooks leaving the Tigerland bar, Reggie’s, the night of her death.
The video first shows four people walking across the street toward a parking lot. Sources told WAFB the next person seen crossing the street is Brooks, who catches up to the young men as they leave.
Investigators with the Baton Rouge Police Department said she left Reggie’s that night with four guys she had just met at the bar. Two of those guys are accused of raping her. After they dropped her off, she was hit by a car on Burbank Drive.

BATON ROUGE, La. (WAFB) - Newly-obtained video shows LSU student Madison Brooks leaving the Tigerland bar, Reggie’s, the night of her death.
The video first shows four people walking across the street toward a parking lot. Sources told WAFB the next person seen crossing the street is Brooks, who catches up to the young men as they leave.
Investigators with the Baton Rouge Police Department said she left Reggie’s that night with four guys she had just met at the bar. Two of those guys are accused of raping her. After they dropped her off, she was hit by a car on Burbank Drive.
Reggie’s has had its liquor license suspended after one of the underage suspects told police the group was drinking at the bar that night. Reggie’s released an official statement on Thursday, Jan. 26, about the ongoing investigation.
The owner of Reggie’s has fully cooperated with the East Baton Rouge Sheriff’s Office, Louisiana State Police, and the East Baton Rouge ABC office since their first requests for assistance in their ongoing investigations and will continue to do so. We look forward to meeting with State ATC and East Baton Rouge ABC officials as soon as possible to address their concerns and to insure they have all of the complete and accurate facts and all information they require to complete their investigation.

Arrest documents show Brooks left a bar near LSU’s campus with three men and a 17-year-old male. She was standing in a dark portion of Burbank Drive near Pelican Lakes Parkway around 3 a.m. on Jan. 15 when she was hit by a vehicle driven by a ride-share driver, investigators said. Brooks later died at a hospital.
Three of the men accused of participating in or witnessing a sexual encounter involving Brooks before her death bonded out of prison, according to records from the East Baton Rouge Parish Sheriff’s Office.
Everett Lee, 28, and Casen Carver, 18, bonded out of jail on Tuesday, Jan. 24, according to their attorneys. The men appeared before 19th Judicial District Judge Brad Myers earlier that day to determine their pre-trial bond amounts. Lee’s bond was set at $75,000, and Carver’s bond was set at $50,000, records show.
Kaivon Deondre Washington, 18, who was given a $150,000 bond, bonded out of jail on Thursday, Jan. 26, jail records show.
The underaged suspect, who was arrested and charged with rape for allegedly having sex with the student, had his pre-trial bond hearing pushed back to February.

And this tells me the cops may have been asking leading questions. We have 17 and 18 year olds trying to answer these questions. And trying to determine what "too drunk" looks likes. When at that age im assuming they havent had that many experiences with alchohol or drunk people(could be wrong here).
The attorney says she was drunk,but not to the point she didnt clearly know what was going on.
Id rather not look like im defending people who may even possibly be rapist. But the way people flew in, ready to throw these young black males under the jail without details was alarming. If we react in emotion,without knowing details. How can thecoli ever complain about harsh sentencing for black men,and black men not getting second chances? How can we expect cacs to have more grace,less jumping to conclusions if we cant?
Plus theres a strong possibility of race and background playing a major factor here.

How did the police know sex was had if she's dead?
Did they just run an automatic rape kit on her body after she was deceased?
Or did they say something that alerted the police to it?
If they can't take a murder confession when you are too drunk then how can they take a confession against your interest (like admitting to having sex) when you are too drunk. So were the guys drunk too and how drunk were they?
It is not as cut and dried as you guys are making it, because they could have had sex with her earlier before she was too drunk, which means that she could have given consent. So we need to wait for more facts before passing judgment.

And for the record, to me, it's obvious that she consented to it. These dudes are NOT rapists in the true sense of the word. This is a technicality in the law that says that if a woman is too drunk, then she "could not have consented" but if it was the other way around, nobody would bat an eye.
However with those facts being stated, that won't save these dudes cause the die has been cast.

Yes they do matter. You have to know at what point that she was drunk to void her ability to give consent. She could have had sex with them before she was drunk. In other words she could have been under the legal limit while having sex, which means that she have given consent. That is why you need to wait for the facts to come out before passing judgment.
