Not even up on the specifics of Hayes record but that gun charge looks like some normal round the way shyt to me.

Hayes' prior gun charge was detailed in the GQ article. It was a technicality. He got pulled over for a minor traffic violation. He had his legally attained and properly registered gun on him. So he told the officer this, cuz that's what they advise you to do. But his aunt had left some prescription strength Tylenol in the glove compartment. Since it wasn't his prescription it counts as transporting drugs, and its illegal to transport drugs with a firearm even if the gun was legal and he had a license to carry it.

It is a textbook example of how Black and Brown folks get the book thrown at them in instances where, more than likely, a cracker would have been given the benefit of the doubt. So anyone in here propping that incident up as a knock on Hayes' character deserves to be called a Cac00n.

I don't think (and someone can correct me) any gun was tested. it may have been, but that bullet fragment in her leg makes or breaks the case in my opinion, just think about it and again you have your opinion, but if Will Smith gun went off while tussling with his wife and he shot her, Hayes as he stated, thought dude was shooting at him, thus him firing his weapon. So who knows breh, who knows.

All the guns recovered by police were tested and only Hayes' gun was determined to have been fired.

The defense's contention is that there was another gun which was removed from the scene by someone. Smith had gunshot residue on his hands and he wasn't close enough to Hayes to have gotten residue on his hand from the shots Hayes fired. A witness testified to seeing someone remove it, unfortunately she ID'd a former cop who had an alibi as to where he was at the time so that really hurt the defense. It's hard to get a jury of Hayes' "peers" to accept a shoddy investigation because most of them have a trust of the police that would need to be overcome. Her misidentification likely caused them to dismiss the defenses suggestions as them just blowing smoke

Accident happened. Hayes left his vehicle armed. Cops weren't called. He was looking for a reason and smith gave him one once he went back to his car for the gun.


Btw, smith had to have been shytfaced drunk. Why would you expect an armed man to wait for you to get your gun?

Wouldnt that mean there would be shell casings inside the car? Smiths friend had time to remove an imaginary gun AND shell casings that fly all over the place?

Why should it be, can't prove there was a 2nd gun to start with? Will Smith didn't have enough GSR on his hands to suggest that he even shot a gun, but it was enough to suggest he had been shot.

Not all guns discharge shell casings. The defense was sure to have the state's witnesses state this as fact on the stand.
