He's done up for two reasons

In NYC the law is you have a "duty to retreat" before using self defense, unless you're inside your home. Meaning your first response before using "self defense" is you have to try to escape or call the police in threat of danger. He went straight for his gun.

Also, the guy with the scissors, was walking away, and he still shot him. He was no longer considered a credible threat.
