Throughout the questioning, she kept saying she was staying in her lane, and only answering as a judge. She didn’t want to give an answer that was going to make her seem for or against trans people. Lawyers give very strategic answers.

Personally, I don’t feel people with men’s bodies should compete in women’s sports against women’s bodies. That would be my personal answer.

She eurostepped that stupid question AS SHE SHOULD. The best way to answer questions like that is to avoid them all together. They're trying to find bias in someone whose entire job involves being as unbiased as possible.

They think they're journalists in the 1950s that can throw a trap at her and then she'll answer in a way that can easily be taken out of context or like they're bill Duke in menace II society. She was a lawyer before she was a judge, she knows what 'anything you say can and will be used against you' means.

There are two perspectives on what a woman is. There is the ever changing cultural ideal of womanhood and femininity and there is the biological answer. She is not a sociologist or anthropologist so she cannot speak on cultural matters, nor is it her place to shape culture. She is not a biologist so she cannot go into the detail of what makes someone biologically female or not. Some people are born intersex and lean one way. Other people are born 'female' but don't have the capacity to make children because of hormonal problems, uterine deformity or illness etc. Some are women but born with a chromosomal disorder that gives them deep voices, body hair, and basically no feminine figure. They have all the hardware(fallopian tubes, uterus, etc.) But look and sound like they could be men.

Her job is to apply the law, which she does not draft. It is not her job to establish definitions on certain things, and as a Supreme Court Justice she would have to vote not make the call herself.

Moreover, as the Sentencing Commission noted in a 2021 report, just 30 percent of offenders who possess or share such material received a sentence within the guideline range in the 2019 fiscal year, and 59 percent received a sentence below the guideline range.

Mr. Berman wrote on his legal blog last week that federal sentencing guidelines for child sexual abuse imagery “are widely recognized as dysfunctional and unduly severe” and that “federal judges nationwide rarely follow them.”
