It actually makes more sense that there isn't Batman to be found.
Bats in this Universe is still fairly young and inexperienced and he hasn't done anything for the police (most of which is corrupt) to believe in him or have criminals really be scared of him. Hell Batman got thoroughly outsmarted by the Riddler and while he 'saved' the day the city is so much worse off for it.

In terms of Batman not being mentioned yet, first scene the news talks about him getting down to stop the Riddler. It's been what 2 weeks since then and from everything we've been told, it's absolute chaos. It's Gotham, it's supposed to be big as fukk, the Falcone/Maroni beef isn't the only thing going on right now.

In Penguin defense in episode 2 he asked him if he can do this....and Vic said yea or something to that effect. He had his way out at that point.
Or maybe he assumed it was a trick question and the Penguin would kill him to tie up lose ends rather than let him walk. Which is probably the truth

He is gonna get killed and that's a fact.
Penguin only allowing this dude to work with him, cause they from the same hood and Vic is homeless, plus...that's how he got his start being a sidekick to a monster and driver.

Batman was literally at MULTIPLE crime scenes and working side by side with the cops. So much so that he was allowed in the GCPD building to talk strategy with the chief of police and play the blame game. He had a building of cops try to catch him as he fed the place when things broke down.
He also saved the mayor in the finale and was seen, ON LIVE NEWS FEEDS, pulling a Moses with a herd of Gothamites!
