Say it unequivocally and unambiguously, cops can ask "clarifying" questions and thereby manipulate you in to waiving your rights. Also remember that you 5th Amendment privilege against self incrimination can be waived if you yourself reinitiate questioning. It can also be waived if cops give you a few hours then re-Mirandize you and reinitiate questioning.

The legal standard at this point is that cops just have to "scrupulously honor" your right. A few hours and a re-Miranda will satisfy that standard.

There are a number of interesting exceptions to Miranda, amongst which is that the confession might not be admissible if it violates Miranda, but derivative evidence might be (say you identify your accomplice, the confession in violation of Miranda might not be admissible but they can find your accomplice and use his testimony against you.) The famed Fruit of Poisonous Tree doctrine does not apply to Miranda!

Miranda is only necessary in "Custodial Intereogations", it is not applicable of: (a.) You're not in custody (b.) Cops are not asking you Express Questions or their Functional Equivalent. If you are not being subjected to a Custodial Interrogation, (but being questioned by cops) your 5th Amendment Privilege against Self Incrimination does not apply unless you expressly invoke it and unless you do your silence CAN be used against you.

There are also a number of exceptions to Miranda including the jail snitch exception, the booking questions exception (inculpatory statements made by defendant during routine booking questioning), and the public safety exception.

Also read up on the "Massiah" rule, I'm trying not to bore you guys cuz I hate when posters type up titanographs.


My advice: Do not wait until you have been Mirandized. UNAMBIGUOUSLY and UNEQUIVOCALLY assert your 6th Amendment right to assistance of counsel and EXPRESSLY invoke your 5th Amendment privilege against self incrimination (read "Salinas V. Texas", do not wait to be Mirandized)

Remember, Miranda can be waived if a court determines you waived it knowingly, intelligently, and voluntarily.

Also remember that State misconduct is a prerequisite to a determining of coercion sufficient to invalidate a confession on the basis of involuntariness. In other words, a court must first find that the cops behavior was misconduct and find a sufficient link between that misconduct and your confession. If not, nikka, yo' ass is going to jail :francis:

Man if the show ever teaches you anything its this....only thing I'll ever say to a pig is Lawyer and get out of my face. Majority of folks don't even know their rights. That's why I think every high school in America should be forced to teach basic law practice for when someone is pulled over, arrested, detained, or when the police try to take your phone as evidence without a warrant. But they don't teach that stuff so most people in America don't know their rights and they don't know what they mean when they're read to them

Always pay up for a lawyer if you can...

Those public defense laywers get paid per case...They don't give a fukk about you, just trying to get a verdict as fast as possible and usually juggling multiple cases...That's why they ALWAYS recommend you take a plea... They don't want to do any leg work...

Take a look at the amount of work Avery's lawyers put in...he had to settle the lawsuit for far less so he can afford that GOAT legal tag team...His nephew unfortunately couldn't do that and got screwed by a lazy fakkit public defense lawyer trying to take the easy way out with plea...

That's why I think every high school in America should be forced to teach basic law practice for when someone is pulled over, arrested, detained, or when the police try to take your phone as evidence without a warrant. But they don't teach that stuff so most people in America don't know their rights and they don't know what they mean when they're read to them

They're trying to solve the case before everything, whether or not you want to make it easier for them is on you. They couldn't care less if you get hemmed up by the system if it means they get to solve the case. Straight from Levy from The Wire: "you don't say anything, you don't do anything, you don't write anything."

I fukked up talking to the ds. They followed me around for hours but lost me cause i realized summin was up. When i got back in town they pulled me over and started aearching my whip telling me they know i picked up a buncha drugs. I had shyt on me but not even a fraction what they said i had. Threatened to throw me in county and take my car if i didnt tell them what i had. The search woulda found ahit in seconds so i gave it up like an idiot. But they did shyt they ahouldnt have done that day ie follow me out of county with no evidence and my lawyer says he should be able to get me outta big trouble cause of it. Cops are scum.

All cause of a snitch. Cops round here dont even want drug dealers. Just users. I fukked up.

While the Search for Teresa Halbach was underway in November 2005, another series of events was beginning in Bonduel, Wisconsin.

A woman was moving from Bonduel, Wisconsin to Maribel. She had rented a house with the lease to start on 1 November, 2005. The house was on a property that included several outbuildings.

In Bonduel, her husband had exhibited bizarre behavior such as sleeping in their attic and sleeping in a fetal position.

She discovered that the labels had been cut from her clothing, and then her underwear was missing. Her husband denied any knowledge. During the week, he said he burned something at their new address and said it was a doll crib. There was a doll crib at the Maribel address, however, it was not burnt, however.

During the marriage, the citizen found that her husband had attempted to burn himself in the past. He also had previously burnt her clothing. He was diagnosed with personality disorder, narcissistic disorder, depressive disorder, and psychosis, but he refused to take medication.

She found that on 31 October, 2005, he visited the Maribel area and had stopped at the rental before the lease began. He spoke of visiting an auto salvage yard. He commented that a woman wanted to take pictures of the rental property on 31 October while he was there, and he felt that the photographer was “stupid.”

During the week, she observed that her husband had scratches on his back and a cut finger that bled intermittently. She was beginning the move while working in Green Bay.

She found her underwear stuffed in an attic closet at the Bonduel home. She also noted a boombox along with cans of Cherry Pepsi Cola near the steps of the Maribel home. Her underwear disappeared again.

On the 5 of November, when they stopped for lunch in the Maribel area, the husband saw a missing person poster for Halbach and stated dogmatically, “She’s dead.”

The following evening, her husband’s behavior turned worse. He refused to allow her into the Maribel rental. The citizen contacted the Manitowoc County Sheriff’s department, and he was arrested on 6 November, 2005. He was charged with disorderly conduct and resisting an officer.

When she returned to the Bonduel home to continue the move, she checked the attic cupboard again for her missing underwear. Instead, she found a pair of yellow lace panties than were not hers. They were about her size and had stains consistent with menstruation. She placed the panties in a plastic bag to ask her husband about them.

About 10 November, 2005 she looked through the outbuildings in Maribel for her missing clothing. She found some of her clothing cut into pieces. She also discovered a can of lighter fluid with a bloody fingerprint.

Unbeknownst to the citizen, her husband had been placed in two separate psychiatric care facilities during his custody. He was released to an outside address in January, 2006. Court records show that address as Glen’s Bar and Grill in Manitowoc. The County did not notify the woman that her husband was free and in the community.

Between November and the end of the year, a few odd things happened. Two explicit adult magazines were placed on the property. Also, her dogs found relatively fresh bones somewhere on the property. She discarded the bones.

While attempting to distract the dogs from the bones, the citizen dropped her husband’s tool chest in one of the outbuildings. A masons’ hammer and a pair of surgical gloves fell from the chest. The hammer had visible dark red flecks.

In January, she noticed a person staring at her home from the gas station/truck stop across the road. She then discovered that her husband had been released as well as his address. When she parked in the parking lot of the bar and grill, he approached her car and insisted that she take him to the Maribel residence and began searching the house. During the search, he struck her. She called the Sheriff’s Department, and her husband was rearrested.

The new charges were burglary, intimidation of a witness, criminal trespass, resisting an officer, and bail jumping.

One night she noted a second floor balcony door was open. She entered the home and secured the door. After that she discovered an opened closet at the base of the stairs with a pair of women’s jeans, a top, and a pillowcase stained with red stains.

She contacted the sheriff’s department. When a deputy arrived, the citizen explained her findings and wondered if the clothing were connected with the Halbach case. She then discussed the other incidents with the deputy. The deputy stated that she believed the Halbach clothing had been recovered! She collected one magazine and the yellow panties.

If the Halbach clothing had been recovered, it was not information that was released at or after the trial of Steven Avery. If not, then the deputy was fabricating.

The citizen was contacted by Manitowoc County Detective Dennis Jacobs. Jacobs is the child sex investigator for Manitowoc County. He insisted that the panties were from a child despite the staining and size. He wanted the citizen to accuse her husband of pedophilia. He also volunteered that authorities had their suspect in the Halbach case.

She told Detective Jacobs of the cut clothing and a previous incident when her husband had burnt her clothing. His response was that was not a crime.

The woman left Wisconsin for a job in Oregon. On 2 March, 2006 the Manitowoc County prosecutor dismissed the charges of burglary and intimidation against the husband. Charges of disorderly conduct, criminal trespass, and bail jumping were also dismissed. He pleaded no contest to the two resisting officer charges and was sentenced to time served.

She believes that the victim services office in Manitowoc County provided her husband with her new address. He was at her door soon after his release.

She considered the events of the week of 31 October, 2005, and her husband’s behaviors and injuries. The citizen believes that there may be a connection with the Halbach disappearance. When she asked her husband about any possible connection, he simply laughed and said no one would believe her if she reported her suspicions.

But, she had developed a distrust of Manitowoc County law enforcement. Her husband was probably correct that the Wisconsin authorities could not accept the concept that someone else did the crime.

As much as I love true crime stories, in all the various forms of media.....often I prefer reading, esp, as it relates to the kind of white trash element of society that this case deals with.....For me, it becomes grating after an episode or 2, to watch these miserable, unintelligent, poor people, and in as much as I understand their situation, economically, it is too much. Watching overweight, undereducated, alcoholic people talk nonsense just as such an unappealing and exploitive tone to it, that I may not make it through all these episodes....Though I have already done my research, and reached my conclusions....

This white trash loser did that shyt, as far as Teresa Halboch, and shyt went down more or less as Dassey described, enough for me to not care if it's slightly off on the narrative... I think it's possible that evidence was 'planted' or manipulated, and thats it's own story from my perspective, but as far as guilt or innocence, I think it's only logical to conclude he's guilty....Perhaps prison warped him slightly, though the guy was torturing small animals at a young age, but a rage against women, as well as sexual dysfunction, it's sad story all around....but it's too much to take these ignorant, greasy people for 10 hours.

I really do not understand how the fukk you can convict that kid beyond reasonable doubt of homicide and rape when there is no physical evidence linking him...Even if you believe the contradicting story his cousin told and the coerced story they put in Brendan's head you can't just disregard the lack of physical fukking evidence...

This isn't rocket science, you have two stories and the evidence...You use the fukking evidence to try and figure out which story is more accurate...
