Yeah its not very complicated. The only way you do not get a murder 1 decision in this case is if you believe Dunn's imaginary shotgun defense. And that means taking the word of a man who fled the scene and didn't call cops, had alcohol in his system, no evidence to support his story, and a conflicting story from his own fiancee.

Premeditation for Murder 1 in lay mans terms simply means Dunn knew exactly what he was doing in the moment leading up to fatal shots. It wasnt an accident, he had the intent to kill. When Dunn reached into his glove compartment, pulled out his gun and pointed it at the davis what was his intent... Either you believe it was to defend himself or it was to kill Davis. There is no other reason to shoot point blank into the drivers side of the vehicle. Not like he was firing warning shots. Plus he got out the car while it was driving away.. crouched on his knee and let off more shots to kill the other kids. Murder 1 is the only charge that makes any sense.. especially since the jury agreed with the attempted murder charges.
