The problem with a law like that is how can someone right of choice supersede the right to life.

Let me help u out here....president bush signed into federal law a unborn victims of violence act, which was inspired by the scott peterson murders, and recognized the legal right of a fetus in commission of a crime. Thats key. Abortion is not a crime and is protected by law, despite ur moral objections to it.

Ironically, ur question is the exact same concern that pro choice advocates had about the federal law....if fetuses are granted legal protection, then how can roe v wade stand? The law is explicit that a crime committed against a woman, changes the definition of the fetus. Kinda Like how the same pills that are legal with a prescription, become illegal without one.

Basically the law was established to prevent cats from harming pregnant women, in order to get out of a pregnancy

I understand what you're saying, but if we want to go by the logic that the unborn child is a person then the woman is also responsible for that person, and she should know better than forcing medication on that unborn child "because I trust him". It woudl have been different if the doctor (an official voice) had tricked her or if the dude would've physically forced the medication on her. I understand emotions, but the "I trust him" defense line only works for so long imo.

There's a difference between the person that's carrying the child deciding to get an abortion and changing the labels on prescription pills (which is product tampering, a federal crime) and causing a woman to have an abortion. He terminated her pregnancy without her permission & committed a federal crime.

Women can be and have been arrested for ending their own pregnancies.

The only way terminating a pregnancy isn't considered "wrong" or a crime is if it's through an authorized abortion done by a doctor.

Illegally ending a pregnancy is definitely a crime, but is it murder?

For me, the murder charge is what comes under scrutiny?

Is a fetus considered a viable living being or not? This answer cannot be situational, and any intelligent prosecutor would consider this before deciding what he will be charged for.

One could argue that if the fetus cannot live outside of the mother's body, then it is not viable. One of the reasons late term abortions are illegal in most states is because the fetus can survive outside of the mother's body (premature birth) at this stage.

Without a doubt, this should be a serious felony charge, but murder is not the right charge. And I guarantee that if he gets convicted and this case was to ever get heard by the Supreme Court, it would be overturned, as it could affect Roe vs Wade, like another poster (sorry I forgot the name) mentioned.

I think it's more along the lines of first degree aggravated assault. Legal experts get in here
