You're arguing murder with the basis of intent self defense is a very different argument that factors in more than that. Castle Doctrine has nothing to do with this lol. I don't see a street fight here, its a heated dispute where both parties felt sufficiently threatened enough to bring weapons. Both parties came ready for smoke. That's not intent, that's identifying a potential danger and preparing against it - which is entirely within everyone's right to do.Both parties would get charged if dude lived, but self defense goes out the window when you engage in confrontation. At least where Im from, say I get in a street fight with someone who mutually agreed to do so, with witnesses present, we both catch a disorderly. If I swing on someone who doesnt wanna fight, assault. If I engage in confrontation, go to my car and grab a gun, then come back and fire....murder. I know Texas is real liberal with gun laws, but the fact that both parties couldve walked away will definitely be a factor. Yall forget, what youre saying is exactly the type of shyt George Zimmermans defense came with to get him off They both met up in conflict when both couldve walked away. Thats never self defense, they were both looking for a fight AND its on camera. Only difference is that one party was outgunned. And even if folks do somehow get off, as mentioned earlier, the dad might get off, the son wont because dude was no longer a threat once he caught two to the chest. The shotgun blast was excessive.
You'd have a point IF they returned for this dispute and immediately shot the man.... but that's not what happened at all is it? They asked the aggressor in the situation to walk away. They fired the warning shot. They stated they'd be willing to use lethal force. They were the ones that got swung on first. You can debate the quality or authencity of those actions, but the attempts to deescalate clearly favored the shooters here
shotgun while he was on the ground was a bit much though cac jr wanted a body. but that's a time frame of 3 seconds at the most. hard to pin a guy for that small of a reaction window
unless they're black of course
