common sense would tell anybody- if the officer knew the law she was actually breaking, he would have no problem explaining while/before he had her cuffed..
shes allowed to crack her window.. by law..
but, let the-coli law experts tell it..
Idk what the law is as it relates to the allowable window range to comply with..(I do see that the ACLU states to open it partially) but I also do know that the officer ordered her to lower the window completely for his safety and she refused...he explained that it was for his safety because in leaving the window partially open, he would have to reach in to hand her the citation to be signed.
Say what you want, but the ability for a cop to follow basic guidelines such as having an individual put their window down all of the way is the type of s*it that works for everybody. Obviously this girl wasn't going to slash his wrists or try to drive off with his hands in the car but who knows?
Again, at the end of the video he reiterated to her the fact that as an officer of the law he gave her an order to do something and she refused, particularly when I doubt that a person has a legal right to not lower their window when requested to by a cop, (therefore no violation of her rights).
And like how someone else in the thread mentioned, being black and being pulled over by the cops requires some degree of diplomacy, even if that cop acted in the wrong, my ass would have complied and not given him one reason to f*ck my day up. I simply file after the incident and take his badge.
Why would I resist arrest to prove a point?
