Amazon driver shows you lames there’s more than one way to run a train. Split that ass in two!!

I thought trains have a right of way?

If there’s a sign designating a crossings coming it’s on the driver.

They have the right of way IF the crossings are protected with gates, lights, or stop signs to warn the public and even then at some crossings, trains have to stop and proceed only when it’s safe.

But by the speed this train was going I can tell this wasn’t a stop and proceed crossing.

As for what shown on the video I didn’t see any signs warning of the train tracks

The train has no idea until approaching if the gates are down or lights are working. It takes them to long to stop if they are moving

Trains run on daily bulletins and time tables. They know before they leave the yard what state the crossings are in and how they need to proceed over them.

Crossings with flashing light and gates have an average 30s buffer before the train get to the travelled part of the roadway.

If the lights and gates don’t go off when they were expected to then someone is going in for statements.

Stuff doesn’t break or malfunction on a schedule though.

Even if the driver is given warning mid route to look out, that’s still different than being able to stop or slow on a dime.

How long before a crossing would it take a train to stop vs a car just waiting an extra 30 seconds to be sure?

I’m not saying trains aren’t ever liable but the onus is on the car.

Train is going at a high rate of speed and the absence of a crossing barricade makes me think this was in a rural area. How was the train not blowing its horn thru there tho and he not hear it?
I watched a news clip. He said that he's deaf in his left ear (which was on the same side as the train).

He still should have heard the train horn, though, with his right ear.

This crossing has no gates. Gates/flashers are determined more less by how many cars that crossing sees per day and a few other factors. Other than that a basic stop sign is what you get.

If you look closely he doesn’t have a stop sign. The road that he turned on to does.

It could be someone stole the stop sign. If Amazon doesn’t have a policy for their vehicles to stop at railway crossings then that brother can sue the railway/county.
I would say there is negligence on his part. Idk how far it would go but it's definitely worth contacting a lawyer

While that may or may not be true. I can definitely say that by law, he didn’t have a reason to stop.
Yeah, that's not true. You have to make sure the road way is clear. If that was a group of children he would have been obligated to stop even with no stop signs. The train gets the right of way just like the children

That’s correct they don’t. So if all protected crossings on the route are assumed working as intended and one of them doesn’t then it’s 💯 the rail road companies fault.

Even some protected crossing trains don’t have the right of way. By protected I mean lights gates signs. And the trains will
know before they reach the crossing that they must stop.

If it’s an unprotected crossing i.e no lights, gates or signs then trains don’t have the right of way which was your original argument. They must stop their train and proceed when it’s safe.

Legally you don’t but not because you can means that you should. Trains don’t always have the right of way.

Some places the tracks get covered with snow and if there are no signs warnings about train tracks then you would never know.

That’s why crossings get checked a minimum of once a week to make sure lights gates bells and signage are not blocked or obstructed.
