Legally you don’t but not because you can means that you should. Trains don’t always have the right of way.

Some places the tracks get covered with snow and if there are no signs warnings about train tracks then you would never know.

That’s why crossings get checked a minimum of once a week to make sure lights gates bells and signage are not blocked or obstructed.

That’s correct they don’t. So if all protected crossings on the route are assumed working as intended and one of them doesn’t then it’s 💯 the rail road companies fault.

Even some protected crossing trains don’t have the right of way. By protected I mean lights gates signs. And the trains will
know before they reach the crossing that they must stop.

If it’s an unprotected crossing i.e no lights, gates or signs then trains don’t have the right of way which was your original argument. They must stop their train and proceed when it’s safe.
The train track I grew up next to had no lights or arm and was just outside of a tunnel obstructing your view.

The train always blew its horn in approaching( I’m only just realizing that now 20 years later)

The train never stopped or slowed unless it was literally just stopping for whatever reason and sitting there for hours.

They have the right of way if the crossing is working as intended and they don’t have a rule telling them to stop and proceed. I’m in the railway business and I’m telling you that if a train has a stop and proceed rule over a crossing and they just blow past the crossing and there is an accident, then that railroad is 💯 at fault because they(read train) didn’t have the right of way.

The train stops, the conductor gets out and lights fusees at night or has a red flag at day to alert traffic to get them to stop. Then he radios the engineer and tells him that the crossing is manually protected and that it’s safe to proceed.

If non of those things happed and a car gets hit by a train the the railroad is 100% at fault.

the whole rail industry has been cutting on safety practices for almost 20 years

this is standard and there are 3 layers of protection against accidents. i saw maybe 1 in that video.

Most of it is lack of awareness. People tend to live in their heads, rather than observing their surroundings. Reminds me of that video of this lady and her lawyer trying to cross the moving train. The lawyer stopped because he realized that the train was coming at alarming speeds, this chick on the other hand :francis:

Nah.

Those trains were long ( 5 to 7 minutes end to end) so they never went fast.

Maybe the sign was on the other side of the tunnel with the obstructed view.

It was basically a threeway intersection the fourth side went to tunnel.


There was no reason to cross the track unless you worked on the other side of the tunnel at the construction yard.
