In rural areas there might not be shyt to warn you, not even a stop sign. I was on a motorcycle trip had to cross this railroad with no signs or lights, that was on a steep hill (so easy to stall out on tracks), and a blind crossing since there were trees on both sides you couldn’t see around until you were almost all the way on the tracks. Scary as hell. Now imagine crossing that in a loud van that could drown out distant, fast moving train sounds.Post the front view

It actually makes sense why he never saw the train coming.
The road curves into the train track and there is absolutely no safety barriers to let him know the train is there. Yeah he could have heard the train but if you are use to driving in cities etc. when a train passes the safety guards are there so you don't go through.
He likely never looked and assume the road was clear.

If you’re marking a left turn, you look left AND check your left mirror for anything you can’t see. He definitely didn’t do that. He just turned left. Now, there absolutely should’ve been safety guards there as well and that’s on the train system.
They have the right of way IF the crossings are protected with gates, lights, or stop signs to warn the public and even then at some crossings, trains have to stop and proceed only when it’s safe.

i mean i know DOT does give CDL exemptions for people that do have things such as hearing loss/vision issues, but this guy has clearly demonstrated that he should not be exempted (if he wants to blame his hearing). apparently you don’t need a CDL to drive around those Amazon vans though, probably a way of cutting corners to let any unqualified mf do the job.It's crazy how people are disagreeing with you in the thread. On top of that, I've seen people fail a Truck Driver physical for not passing their eye exam. I've even seen some fail for high blood pressure. But somehow this dude is hired to be a driver. Crazy

I believe the National Highway Traffic and Safety Administration over you.They have the right of way if the crossing is working as intended and they don’t have a rule telling them to stop and proceed. I’m in the railway business and I’m telling you that if a train has a stop and proceed rule over a crossing and they just blow past the crossing and there is an accident, then that railroad isat fault because they(read train) didn’t have the right of way.
The train stops, the conductor gets out and lights fusees at night or has a red flag at day to alert traffic to get them to stop. Then he radios the engineer and tells him that the crossing is manually protected and that it’s safe to proceed.
If non of those things happed and a car gets hit by a train the the railroad is 100% at fault.
