Moments before LSU sophomore Madison Brooks got into a car with four people she met at a Tigerland bar, one of them stared into his cell phone camera and said "They finna rape" her, video footage played in a courtroom Thursday morning revealed.

Brooks, 19, was hit by a car and killed on Burbank Drive; before that, prosecutors say a man and a 17-year-old raped her in the backseat of a car while two men sat in the front seats.

On Thursday, lawyers for the then-juvenile, Desmond Carter, attempted to convince a judge to reduce his bond, which would allow him to get out of jail before trial.

Prosecutors objected, and played evidence that they said showed the crime being committed: recordings Casen John Carver and others made standing outside the car and then in the driver's seat. The videos showed a man and a woman having sex in the back seat; their faces were not visible, but a sheriff's office detective testified it was Carter and Brooks.

In one of the videos, a woman could be heard yelling "get off" as loud music blared and other men in the car cheered. In another video, Carter was shown holding a gun and dancing; prosecutors said the video was taken minutes after Brooks was dropped off after the rape. It was not clear who took that video.
Freeman, Carter’s attorney, said there no mention of a weapon during interrogation, and no gun was recovered by detectives during the investigation.

Carter and Carver, both 19, face charges of first- and third-degree rape. Kaivon Deondre Washington, 19, has been indicted for aggravated first-degree rape and video voyeurism. Everett Lee, a fourth man arrested in the case, has not been indicted.

BATON ROUGE, La. (WAFB) - An attorney representing one of the suspects in the rape case of Madison Brooks claims an LSU student had consensual sexual relations with Brooks the day prior to her death.

The attorney claims that information, if true, could help exonerate his client. In the new court filing, the attorney says it is crucial that he be allowed to subpoena and interview that unidentified male LSU student. Attorney Joseph J. Long filed the “Motion for Preliminary Examination” on Monday, March 11, 2024.

District Attorney Hillar Moore said by phone late Monday, that Long’s motion is “totally improper” under the law, and he will object to it.

Brooks, a 19-year-old LSU student, died days after being run over by a car on Burbank Drive on January 15, 2023, after being left on that roadway. Hours prior to being run over, Brooks got into a vehicle with four males as they were leaving a bar near LSU. Prosecutors say Brooks was too intoxicated that evening to legally consent to sex.

Prosecutors have since filed rape charges against all four of those male suspects. Three of those suspects have been indicted, including Casen Carver, the driver of the vehicle.

Because Carver was indicted, he does not have a constitutional right to a preliminary examination, except for when there is a need for preservation of evidence. Carver’s attorney, Long, argues in his new motion that a preliminary examination should be allowed in order for him to try to get statements under oath from the male student as well as from a female friend of Brooks.

The lawyer claims Brooks allegedly had sexual relations with the student in the early morning hours of January 14th, the day prior to her being run over. Long says results from the Brooks autopsy showed signs that are consistent with sexual intercourse. Long claims that could have happened during her alleged sexual encounter with the LSU student, nearly 24 hours before.

In his filing, Long alleges that a close female friend of Brooks picked Brooks up from the student’s home and “can testify to her and MB’s (Madison Brook’s) intimate conversation during their car ride, including MD’s admissions about sex” with the student.

The attorney says the female friend has indicated she does not want to testify in the case. And, the attorney says he has been unable to contact the unnamed male and believes that the student is “apparently a hostile witness to the defense and a potential flight risk” since his hometown is outside of Louisiana.

If the judge approves his motion, Long is asking for the preliminary examination to be held on April 30, 2024.

Moore, the district attorney, said Long’s motion is “completely contrary” to the statute that covers these types of allegations. Moore said he will file a motion that any hearing on the matter be closed to the public because of the sensitive nature of the allegations.

A new motion filed in court this week has revealed surprising new allegations in the case of an LSU student who was struck and killed last year.

Madison Brooks died on Jan. 15 after police say she was raped and struck by a car following a night out at a bar.

Desmond Carter, 17, Kaivon Washington, 18, Everette Lee, 28, and Casen John Carver, 18, were indicted in connection with her death.

Carver's attorney filed a motion on Monday claiming that two new witnesses can testify to Brooks' injuries possibly being linked to a sexual encounter the day before her death.

According to the motion, an LSU student by the alias of "John Snow" claims he had consensual sex with Brooks in the early morning hours of Jan. 14.

A second witness, a friend of Brooks by the alias "Haley Cage," claims she picked up Brooks from Snow's apartment and heard details about the sexual encounter.

Carver's attorney claims that the testimony from Snow will "gut the state's theory of the case" regarding the suspects causing injuries to Brooks.

The motion asks for a preliminary examination to go over these new allegations.

Baton Rouge police say Brooks left Reggie's Bar in Tigerland with the suspects when she asked for a ride home.

Washington and Carter are accused of raping her in the rear seats while Lee and Carver were in the front seat.

The four suspects then dropped her off at a random location, which led to her being hit by a vehicle around 3 a.m. on Burbank Drive near Pelican Lakes Parkway.

Deputies say Brooks' toxicology reports show her blood alcohol content was .319g%. According to the University of Notre Dame Research, the effects of a BAC between .350g% and .399g% are listed as alcohol poisoning. Tetrahydrocannabinol was also found in her system.

This is terrible. It’s unsafe for women to go out drinking like that by themselves. I don’t know if she knew any of these dudes ahead of time but women have to watch each other’s backs. There’s too many degenerates like this out in the world. They’re young but should know better than this.
