Which has absolutely nothing to do with my question because we're only taking a snapshot of the earths positioning at 12 noon, the same time every day

What you describe in your question is assuming that the Earth iself doesn't spin.
Because it spins on it's own axis, The Earth never "faces away" from the sun, no matter where it is in its revolution around the Sun

It'd be easier to physically demonstrate but the Earth rotates as it revolves around the sun..
The sun is always there and our rotation is constant. What you seem to be saying is the Earth isn't rotating at all.. As in if we're facing the sun at one time of the year then we're facing away from it 6 months later. That would be true if we weren't rotating but we are.
