His breaks did not go out and he was driving 85 mph when the speed limit was 45 mph and he drove past a runaway truck ramp before plowing into stopped traffic

How do you know his brakes didn't go out? What evidence did you have? They did go out. It's VERY easy for a Truck to lose brakes with a 20,000lb load going downhill
