Like I said, the list is simplified. Within those tiers, there are also smaller levels. For example:

Black Panther, Dr. Doom and Stark with prep can defeat and plan around cosmic threats. The purpose of the list was to list them based on physical attributes/default destructive capability. I.e. without prep time.
Deadpool and Deathstroke are more or less equal in stats. Deadpool has better regeneration and Deathstroke is smarter/thinks faster.
For example New 52 Superman can do this, bench press the weight of the earth for 5 days without sunlight casually and broke a sweat only once, at the end of the five days:
He can also strike with enough force to shake the entire planet, his hits can be felt even all the way in low orbit:
As you can see, on his own, he has planetary level strength/power.

Beta Ray Bill (Basically Thor but an alien):
Under certain circumstances Hulk:
Lanterns:
And of course, the person the tier was named after, The Silver Surfer, who can not only destroy planets but Solar Systems as well:
All of these people belong in the Herald tier. When they fight each other it is relatively even.
I have a lot more, he's taken Beta Ray Bill, Gladiator, Silver Surfer and Ronan all at the same time and beat them all. Adam Warlock had to stop him from killing them.
when you said deadpool as better regeneration. Deathstroke can't regenerate, he has speedy recovery... , deadpool is almost immortal with his ability to regenerate
batman without prep isn't anywhere near Black panther or dr. doom without Prep...batman would have to use every trick in the book just to be able to retreat, so he can live and fight another day.
you can make several tiers i agree and there's some many variants it's hard to be accurate
I remember when Hulk tried to fight Surfer in Silver Surfer #125...He tried everything he could to fight Surfer..got mad..all that shyt. Surfer got bored and sucked the gamma radiation out of his body. Turned him back into Banner and went back on his way like he was a insect. Lol.
the Joss Whedon effect. Nothing but trash. I still haven't seen Justice League and don't plan to. I'll watch Aquaman to see what James Wan do. Anything that Whedon touch is garbage.
Black Panther and Captain America are both above street level.
Hell BP is the King Of The Dead. He can summon his ancestors to battle on his behalf and has access to the knowledge of all past Wakandan monarchs. Even without that the Heart-Shaped Herb gives BP strength and Stamina on par with that of Wolverine and Sabertooth.
BP and Captain America both would kick Batman’s ass.
Iron Man and Cap had a good run but Downey and Evans probably done soon. It makes sense to have Black Panther and Spidey be the new leadership of the squad.
