It’s complicated to say the least. We aren’t like other industries and our collective bargaining process isn’t like any other industry sans airlines. Sick pay is a big deal for a lot of rail employees, but obtaining it isn’t a simple process even tho it seems like it could be. Yes, congress had the power to assign is paid sick days but that was almost 5 years of bargaining with the railroads to no avail. This is the first bargaining round that we’ve really fought for sick time, and coming out of the pandemic, it should have been an absolute thing, but the chips didn’t fall where we wanted.
Congress (mostly republicans ), in my opinion, gets secondary blame. Most of them don’t understand how the RLA (Railway Labor Act) works, they don’t understand the lifestyle of rail employees and being on call. They just see the money we make and say pretty much say fukk those guys. Before the dispute made it to congress, it went before a Presidential Emergency Board. The PEB is non binding arbitration, however, what they say is usually what is imposed on us (historically speaking). The PEB shot down our request for paid sick time, essentially putting an end to our request. The republicans and Manchin almost unanimously agreed. We got some unpaid sick time and I think there should be momentum in the next bargaining round to move forward with paid sick leave.
