I does take away from real victims. I can't understand someone ruining a person's life like that. But this is the world we live in. My post was not my personal opinion though. It's the law, however unfair it is you can't just say "F" it Ima do what I want. Unless you know them personally I would put myself in the position. I never left the club with guys, if I did go see someone it was an established relationship to protect myself and guys should to the same. Don't go for low hanging fruit. Your example of your ex that was a relationship she never said anything to you...(:patrice: you had sex with a passed out person or she passed out during or what :whoa: just trying to clarify) she didn't press charges after every arguement. The key question is still: did the victim consent or not? Regardless of whether the victim was drunk or sober, if the sex is nonconsensual, it is rape.

The hypothetical girl could if she did NOT consent. If she did consent, she would have to show that she wouldn't have sex with you absent drinking and smoking.

How is that overeaching(?)/overeacting (?) Have you been accused of rape before or had someone lie on you about rape? I have had that happen to someone close to me and even though he was found innocent in the end it was a big mess. He got kicked out of school, lost credits, had his reputation dragged through the mud etc...so yea, no I don't take it lightly and think it is something to avoild if you can especially a for quick nut and in this case possible STD's from some random.

As for the rest :rolleyes: You changed your post because you know its not just about consent it is the intoxication part which was my point because people are in here saying she said yes so its not rape.
