Maybe I wasn't clear. The ultimate question as to whether a rape occurred is whether the victim consented or not. In cases of intoxication and rape, the determination is whether her intoxication impaired her ability to consent (if she gave consent).

The key question is still: did the victim consent or not? Regardless of whether the victim was drunk or sober, if the sex is nonconsensual, it is rape. However, each state has different definitions of “nonconsensual”


And remember, the law is about what you can PROVE, not what you know.
