there are thousands of innocent people who are rooting behind bars for crimes they didn't commit.........if alleged criminals didn't have lawyers or trials then you would have alot more innocent people in jail

I actually think the man suffers from a mental illness and thus isn't as culpable for his actions as someone who didn't. I had the same visceral reaction as everyone else when I first heard this story and thought death would be too nice a punishment for him. But after reading more and thinking about how any human could do what he did, I came to the realization that the man has to obviously be mentally ill. And even though illness doesn't excuse what he did and he should be punished, he prolly doesn't deserve the death penalty IMO.

I would argue for a more lenient punishment. Life behind bars with the possibility of parole in 30-40 years if he passes psychological evaluations and is no longer a threat to society.

one of the first elements of any first degree murder charge would be that the action be willfull.........if he's suffering from mental illness and couldn't control himself then it wouldn't be willful........plus his past abuse and the suicide letters might be introduced as mitigating evidence against any death penalty charges

he'll go to jail.....there is little chance he gets off even with the mental illness claim.....but he can escape the death penalty......and possibly get a life with the possibility of parole

I'm sure they tried to get a plea agreement... "I'll plead guilty if you give me 20 years." or the like. The prosecution probably said "Nah, AND we're seeking the death penalty." so his only choice to save his own life is to plead not guilty.

a lawyer is bound by his professional duty to defend a client even if he doesn't like the defendant.......our responsibility is not to lie for the defendant or get him off using deception......all we do is give the client advice on how their situation with respect to the law......then all we do is argue what the client would argue if they knew the law

also the guy defending Castro is probably a public defender who isn't getting paid much and would probably get paid the same if he was defending someone who had a traffic violation

stop blaming lawyers for the worlds ills and blame the people who commit the ills.........all we do as lawyer is translate the clients arguments into legal arguments........nothing more

From the years that I was a cop, there are some cases where the defendant who is guilty as a turd will still want to plead not guilty. Their lawyer has to listen to the person they are representing. Their lawyer will go through all steps in court to support his client's case. He will question the victim, the cop/investigator, etc. The answers to his questions won't support his innocence though, moreso they will prove his guilt. In these cases, the defendant will be found guilty. The defense attorney will at least be able to say he tried.

I agree that everyone should have a right to a proper defense but in rare cases like this one all that sh1t should be thrown completely in the bushes.




They can just skip a trial and execute him if they want, regardless of what he pleads.
