well that's simply because conservative justices are more ideological and sensible in their actions so they don't retire when their political party doesn't have the white house and they're also younger. clarence thomas is on the bench because thurgood marshall didn't hang on until a dem could replace him. anthony kennedy hung on until a republican became president. if hillary won he would have gutted it out until 2021. now he wants to give the republicans a chance to get his replacement through while they have the senate. RBG should have departed years ago when obama was in office and the Ds had the senate, but she wants to die in the robe, her replacement be damned.
