Social media isn't work but is used as a marketing tool and a way for companies to interact with fans. When you got your company's name in your bio or, like in Gunn's case, have a promotional picture of the film you are working on in your header and tweet updates about the film, you are representing that brand. And the company that controls that brand are well in their right to hand down any disciplinary action they see fit when you post something that can tarnish that brand.
I had a coworker get in trouble for something they posted while having the company's name in his bio.
I doubt Disney were even thinking about checking a person's Twitter back in 2012 let alone searching back to 2008. They are a film company and they would look at a person's filmography instead online activity. Also Marvel Studios would've been the ones hiring not Disney themselves.
I don't see what past movies have to do with anything. Just because someone made some r rated movies with crude humor doesn't mean that person can't make a pg-13 film that's meant to be suitable for the family. You bring up he used the dirty dozen(which is a great film) as the pitch...okay lol I'm sure he meant the overall premise and not that the guardians would be made up as rapists and shyt.
Either way, its only happening because of the SJW's and #Metoo movements. Disney didn't care that he prattled off on Twitter, till currently. Even then, a person's social media account should remain mutually exclusive to their work.
My point with bringing up his pitch, was that he quoted a completely dark/fukked up movie to work on a kiddie film. They've always known he was a character, and especially cheeky one at that.
