He's asking questions. He could have been a Baptist Convention and ask questions too.
There is a reason why TV Shows make people sign release forms, before they publish footage. That way, they have written agreement that they are allowed to use the footage. Unless you have such a written agreement, the people in the videos can always sue you for publishing material with them without their consent. You also don't need to be a breathalyzer to realize when people are drunk. And when these guys frequent party spots at night to ask people stupid questions, you can make a reasonable argument that they are deliberately looking for drunk people and trying to prey on them for content. And even if you disregard all of this, it's still not a free speech issue.

Yes, correct a release form is probably recommended, but nobody does that. If you say I don't want to be on camera before or after the fact then you'll see the person pixelated out, so there was an exchange indicating consent was not given.

I've been interviewed by local news and no release form was involved. When they ask "can I interview you Newworldafro" and I agree that is the consent, no different than Hawk Tuah girl.

A street interview is implied consent, in place of a release form, if you see a camera in your face and you agree to it.

If she sues she is going to loose. But If for some reason she wins, they'll take that biitch to the Supreme Court to win that case.

I don't know why you keep arguing. It's not a free speech issue, because it is not your speech, it's somebody elses speech, and it’s not about a private citizen against the state, it's between two private citizens and hence about the general right of privacy. And no, if you are drunk when you're being interviewed it's not implied consent, because you are drunk and can argue that you didn't have the capacity to consent.
