That would actually be a good thing.Imagine if she won how many Youtubers/Influencers that do "Man on the Street" interviews in some ways would be facing lawsuits.
That would actually be a good thing.
1. These people are not professional reporters. Why would it be a good thing?
Asking a question on the street deserves a lawsuit? It's no different than a professional reporter asking a question on the street.
#1 it's protected by the 1st Amendment
1. These people are not professional reporters.
2. They are not simply asking questions, they are specifically looking for drunk people in order to make them look stupid or generate rage bait. That's why they deserve a lawsuit.
3. They are clogging social media with their lazy content, which is why it would be a good thing if they got sued and disappeared.
The problem too for these social media folks too is they’re screwed because they don’t have a big corporation backing them.,Tv stations get sued all the time but those people can go at the corporation and sue them instead of the reporter directly. It’s a dirty game out here and you have to make sure you do what you can to make sure you protect yourself. It’s why people will make content for YouTube and make sure they’re not showing random people in their videos and all that. You don’t know who will try to sue you. Getting drunk people to say things to make you go viral is something you might want to be careful with… especially if you go viral.1. These people are not professional reporters.

filming drunk people and then putting them on the internet is not free speech. Free speech means the state is not allowed to persecute you because it doesn't like your opinion. It doesn't mean that a private citizen can't sue somebody for deliberately making them look stupid on the internet.Nah not a lawsuit. Again it's 1st Amendment protected speech. You don't want to go down that road.

smart ladyI would think she gave constructive consent by adopting the footage for her media personality and benefitting from it.
