I'd say if they are supporting the invasion of privacy and/or supporting the government in stopping heroes who won't agree with them, then they are villains of a different kind than villains who just want destruction or chaos. All villains don't want the same things, but it doesn't stop them from being villains. Villains can have good intentions in their minds but are completely misguided in realizing their goal, that's what makes them villains. It's not just about being on some michael myers 100% evil not being able to be reasoned with type of stuff.
