He left her severally disadvantage and he needs to be make up for that. Even a job will give you unemployment for over a year when they let you go but he gets to walk away from a breach contract unscathed?

Depends on what's in the best interest of the children. I'd argue that living with the parent who has resources and spending 8 hours a day at day care would be better for the children than living with a parent who has no money for food, housing, clothing, medicine, or education. And you seem to have no problem with the children being taken away from him, at all.
