They're hoping a court sides with them and compels the witnesses to show up.

They seem afraid to go it alone either because they believe it's important to show the public that the institutions do work despite being under attack or they feel constituents will be turned off if they look to forge ahead alone without first showing the institutions aren't operating as intended.

Either way, they need to get to it.
