The International Court of Justice ruled that Israel's occupation of the West Bank and East Jerusalem was illegal and constituted apartheid on Friday.
Also ruling that Israeli settlements in those areas were illegal, the world court said in its a non-binding advisory opinion that Israel must make restitution for the occupation and dismantle its settlements.
It called the occupation "de facto annexation" and said it was enacted through "systematic discrimination, segregation and apartheid."
Restitution would include, the court said, "evacuation of all settlers from existing settlements and the dismantling of the parts of the wall constructed by Israel that are situated in the Occupied Palestinian Territory, as well as allowing all Palestinians displaced during the occupation to return to their original place of residence."
The court also said that Gaza has effectively been occupied by Israel despite its 2005 withdrawal from the enclave because of Israel's ability to control its borders and restrict the passage of good and people.
The court's panel of 15 judges from around the world said Israel has abused its status as the occupying power in the West Bank and east Jerusalem by carrying out policies of annexing territory, imposing permanent control and building settlements. It said Israel must end settlement construction immediately.
In the opinion read out by court President Nawaf Salam, the court found that "the transfer by Israel of settlers to the West Bank and Jerusalem as well as Israel's maintenance of their presence, is contrary to article 49 of the Fourth Geneva Convention." The court also noted with "grave concern" that Israel's settlement policy has been expanding. It further said that Israeli policies "constitute an obstruction to the exercise by the Palestinian people of its right to self-determination."
The court also found that the UN Security Council, the General Assembly and all states have an obligation not to recognize the occupation as legal and not to give aid or support toward maintaining it. The case stems from a 2022 request from the UN General Assembly, predating the war in Gaza that began in October.
Israel's Foreign Ministry said it rejected the opinion, describing it as politically biased and "completely detached" from reality. The statement criticized the ruling for "ignoring" the atrocities committed by Hamas on October 7. The ministry also said that the opinion contradicted the principle that peace could only be achieved through "direct negotiations," accusing the Palestinian Authority of attempting to undermine Israel through international tribunals.
Furthermore, Israel noted that the "blatantly one-sided" opinion was advisory and not legally binding, repeating its "commitment" to the rule of law and international law.
Israel's prime minister, cabinet ministers, and lawmakers have categorically condemned the legal opinion issued by the International Court of Justice (ICJ) on Friday. The opinion labeled the Israeli occupation of the Palestinian territories as "unlawful" and characterized it as "apartheid."
Prime Minister Benjamin Netanyahu said in a statement that the Jewish people cannot be considered occupiers in their historic homeland. "The Jewish people are not occupiers in their own land, including in our eternal capital Jerusalem nor in Judea and Samaria, our historical homeland," Netanyahu said." No absurd opinion in the Hague can deny this historical truth or the legal right of Israelis to live in their own communities in our ancestoral [sic] home."
Palestinian President Mahmoud Abbas welcomed the court's decision, calling it a "victory for justice." Abbas stated, "The Palestinian presidency urges the international community to demand that Israel, as an occupying power, end the occupation and withdraw unconditionally."
Israeli President Issac Herzog has also commented on the court's opinion, saying on X that he "rejected outright the one-sided and ill-judged advisory opinion of the ICJ." "Their words undermine the entire notion of the process of negotiations between Israel and the Palestinians," he added.
Israel's Justice Minister Yariv Levin commented by saying that "No lies [by the World Court] will change the simple fact: the Land of Israel belongs to the people of Israel."
Israel's Foreign Minister Israel Katz has also commented on the court's legal opiion, saying it "Ignores the past and the historical rights of the Jewish people in the Land of Israel." Katz added that the ICJ decision is "dangerous" as "it plays into the hands of the extremists and encourages the Palestinian Authority to continue its path of slander."
Top Likud lawmaker and the head of the Knesset Foreign Affairs and Defense Committee, Yuli Edelstein, has harshly criticized the opinion, saying that the ICJ is "hijacked by Islamists" and encourages terrorism.
Far-right National Security Minister Itamar Ben-Gvir has also commented on the court's opinion, labeling it "antisemitic" and calling for an immediate annexation of the West Bank.
The Religious Zionism faction at the Knesset, including Finance Minister Bezalel Smotrich and National Missions Minister Orit Strock, have reacted similarly, taking to X and writing "The answer to The Hague: Sovereignty now," referring to an Israeli annexation of the West Bank.
Opposition lawmakers have also slammed the World Court's decision. Opposition Leader Yair Lapid said that the ruling is "disconnected, one-sided, tainted by antisemitism," and "serves only Islamic terrorism."
Yisrael Beiteinu party chairman Avigdor Lieberman said that the court's decision is an "antisemitic act," charging the court with "launching a war" on Israel, who is "already fighting six others."
In a post on X, Israeli Energy Minister Eli Cohen said “Judea and Samaria is the land of our ancestors,” referring to the Israeli name for the occupied West Bank. “For 2,000 years we prayed to return there and no distorted decision of a biased and anti-Semitic court will move us an inch,” he said. He further referred to the 2005 Israeli withdrawal from Gaza as a mistake, saying Israel would not replicated it by ending its occupation of the West Bank.
