Jurors Are Excused For The Day

With the jury back in their box, Merchan told them the testimony read-back would take around 30 minutes. Several jurors nodded.

The judge then asked them to decide what part of the instructions they needed to hear again, and said all of their requests could be handled Thursday morning.

"You can decide tomorrow morning if you'd like to work late, if necessary," he told them.

Jurors Request To Hear Parts Of Testimony Again

With Trump, his attorneys and the prosecutors back in their seats, Merchan addressed the room.

The jurors had four requests. They wanted to hear several parts of David Pecker’s testimony again — the part where he spoke to Trump during an investor meeting, the part where he talked about Karen McDougal’s life rights and the part where he talked about the 2015 Trump Tower meeting where he agreed to use his magazines to give Trump’s campaign a boost. They also wanted to hear the part of Michael Cohen’s testimony where he spoke about that 2015 meeting.

As the prosecution’s first witness, it’s been well over a month since jurors heard from Pecker.

Merchan left the room to allow the attorneys time to figure out which portions of the transcripts should be read.

The investor meeting the jurors referenced seemingly refers to a mid-2016 presentation Pecker said he was giving in New Jersey when he received a call from Trump. He said he took the call, and the pair discussed McDougal’s interest in selling her story about her alleged yearlong affair with Trump. Pecker said he recommended that Trump buy the story to lock it down, but he did not want to.

Pecker recalled Trump telling him, “I don’t buy stories. Anytime you do anything like this, it always gets out.” They agreed to reconnect later, Pecker said.

Pecker’s American Media Inc. ended up paying for McDougal’s story, forking over $150,000. Pecker testified that he almost went through with a deal to transfer the life rights to Cohen and Trump, but it fell through.

Jurors Listen Intently To Instructions

The section Merchan read back to the jury included instructions on how to make inferences from the evidence they heard, the meaning of “proof beyond a reasonable doubt,” and how to evaluate witness testimony. It also explained parts of the law, describing the charge of falsifying business records in the first degree and how the prosecution must prove the defendant falsified records in furtherance of another crime.

As the judge spoke, some members of the jury took a few notes. But most of them simply listened.

Court Reporter Reads Parts Of David Pecker Testimony

A court reporter read sections of testimony from former American Media Inc. CEO David Pecker as the attorney asking questions, while a colleague of hers read the responses from the witness.

The first portion was about Pecker’s recollection of a mid-2016 phone call with Trump about ex-Playboy model Karen McDougal’s intent to sell her story about an alleged affair she had with Trump. Pecker said he told Trump to buy the rights to McDougal's story in order to prevent it from getting out, explaining that he thought it would be damaging to his presidential campaign. But Trump did not want to pay, according to Pecker.

A second section recalled how Pecker nearly transferred the rights to McDougal's story to Michael Cohen and Trump, but ultimately he decided against it and asked Cohen to rip up the deal.

"He was very, very angry, very upset," Pecker had said of Cohen. AMI was never reimbursed for the sum it paid McDougal on behalf of Trump.

Trump Reads Headlines Again

The former president read favorable headlines aloud before court Thursday, sharing out-of-context snippets from opinion pieces that seemed to bolster his argument.

“There was no fraud, there was no conspiracy, it’s that simple,” read one.

Another, from Judge Jeanine Pirro: “This is a kangaroo court. This is unheard of. I’ve never seen anything like it.”

Trump then described Pirro as “a very good woman, a very smart woman.”

Trump also told reporters he would like to answer their questions as “they’re very easy questions to answer,” but claimed he was prevented from doing so by the gag order.

Trump Blames Judge For Jury Instructions His Lawyers Negotiated

In two social media posts Thursday afternoon, Trump blamed Judge Merchan for a litany of his legal team’s own, very deliberate, decisions. That includes the jury instructions his attorneys spent hours hashing out earlier this month with both Merchan and the prosecution.

Nevertheless, Trump called the instructions “UNFAIR, MISLEADING, INACCURATE, AND UNCONSTITUTIONAL” in his post.

Trump also blamed Merchan for what was likely his own attorneys’ decision not to obtain tax records from his former lawyer, Michael Cohen, which would open him up to further scrutiny.

Trump Supporters Attack Trump Protester Outside Courthouse

Footage relayed by freelance journalist Oliya Scootercatser from outside the courthouse appears to show supporters of Donald Trump attacking a protester, repeatedly ripping up the person’s protest signs, and shoving and yelling “fukk that bytch” in their face.

The protester's signs read “REMOVE TRUMP” and “TRUMP’S DECEIT IS BEYOND A REASONABLE DOUBT,” among other things.

When will Trump be sentenced?

Judge Juan Merchan will issue Trump's sentence in a July 11 hearing.

Defendants are often "remanded" pending sentencing, or kept in custody while they wait for their sentence.

But some experts say that is unlikely in this case. Even if Trump gets remanded, he could probably get a bail in the range of thousands of dollars set by an appeals court to stay out while waiting for the appeal to wrap up.
