Remember when Trump tried to throw out a majority of black votes in swing state black cities in federal court to overturn the 2020 election? Oh.

The Trump administration has formally scrapped an Obama-era policy that was meant to curb racial discrimination in schools but that became tangled in a national debate over school safety.

Officials from the Education and Justice departments finalized the rollback Friday, just days after it was proposed by a federal panel on school safety. President Donald Trump formed the panel in March as the government’s response to the February school shooting in Parkland, Florida.

In revoking the rule, federal officials said they won’t intervene with schools’ disciplinary decisions as long as they don’t violate federal discrimination laws.

The 2014 policy urged schools not to suspend, expel or report students to police except as a last resort. Instead, it promoted “restorative” discipline measures that don’t remove students from the classroom. President Barack Obama’s administration issued the guidance after finding that black students across the U.S. were more than three times as likely to be disciplined as their white peers.

The policy also warned that schools could face federal investigations if their statistics showed a “disparate impact” for certain races. Schools that disciplined certain races at disproportionate rates, for example, could be found in violation of federal law even if it wasn’t through intentional discrimination.

The Trump administration has dismantled key federal tools for imposing accountability on police forces engaging in systemic racial discrimination, severely hampering efforts to heal the wounds of the police killing of George Floyd and the ongoing protests convulsing the country.

Under Donald Trump, the US justice department has allowed federal mechanisms designed to impose change on racist police agencies to wither on the vine. As a result, law enforcement agencies that practice racial profiling, use excessive force and other forms of unconstitutional policing are now free from federal oversight.

The most important of those tools, known as consent decrees, were deployed extensively by the Barack Obama administration in the wake of previous high-profile police killings of unarmed black men. They included the death of Michael Brown in Ferguson, Missouri, in 2014; 12-year-old Tamir Rice in Cleveland, Ohio, that same year; and the 2015 death of Freddie Gray in Baltimore, Maryland.

Under Obama, 14 consent decrees were enforced upon troubled and discriminatory police agencies. By contrast, none have been issued in the more than three years of the Trump administration.

By scrapping the use of consent decrees, Trump has effectively made it much harder for the US to recover from the turmoil roiling the nation. In the absence of federal pressure, any reform impetus will have to come from cities and states acting in isolation or from inside police agencies that are likely to be resistant to change.

The decision to scupper consent decrees was taken by Trump’s first US attorney general, Jeff Sessions. As one of his final acts in the post, in November 2018 he released a memo that so drastically curtailed the remit of the agreements as to render them moribund.

“It is not the responsibility of the federal government to manage non-federal law enforcement agencies,” he said.

The White House is repealing and replacing an Obama-era rule intended to combat historic racial discrimination in housing.

In a Wednesday announcement, the White House said it would be rolling back the rule as a part of a broader deregulation push.

What does the AFFH rule do?

It tells jurisdictions that receive federal housing funds that they have to assess what patterns of housing discrimination they have and then come up with a plan to diminish them. It also provides a data-based tool for communities to use in doing this assessment.

The rule was implemented in 2015 under the 1968 Fair Housing Act, a federal law that says federal agencies have to administer any housing-related programs "in a manner affirmatively to further" fair housing. Advocates said that the rule at long last gave specificity and teeth to that provision.

The rule went into effect in 2015, but in January 2018, the Trump administration gutted it, telling cities they no longer had to use the tool (and that they had two more years to submit their assessments).

Now, the Trump administration says it will be replacing the rule with one that will give greater power to local communities. In its announcement, the White House portrayed the Obama version of the rule as an example of federal overreach, and also one that will threaten Americans' ability to buy homes.
