That child you are referring to was their second child, that's when they got married. They weren't married for their first child, and she got pregnant at 16 years old and gave birth to the first child at 17 years old. First child even bares his mother's name (Jeter), rather than his father's (Loving).

So many people made a big deal about Birth of a Nation not being super accurate, that I figured historical accuracy was the utmost of importance for such a film like this one, especially when the topic is about stuff that happened less than a century ago and was documented.
