that's how they get ppl, when they seize a car, they have to check for quote on quote "inventory" reasons and that's how they get people. The statute is set up just as if you lied and said I don't have nothing else on me, but you came into the precinct with still crack on you, they can charge you. Something similar happen to me because I didn't have no license, they automatically assumed I was a hood and they wanted to search it, I said "I do not consent to a search". My little brother was there and he heard me when I said it. They got mad and told us to get out, they told me to get out first, I told my brother, no, you get out first. So he got out, then they got mad, then I lock the doors and jumped out. They were pissed and took me in for no license. Then they supposedly said they found weed in the car
. When did they find it, damn sure wasn't at the scene because I didn't consent to no search. I told them I was 2 blocks away from my house and my brother was a licensed driver because the car was in my father's name. They wanted to be dikk heads. They charged me with possession, driving without a license. My argument from the jump was my car should stayed where it was. It was on the street where you could park all night, they had to reason to take it especially without me going through the whole due process procedure. You cannot adjudicate me at the scene without first a trial with my peers. I wasn't paying those fees. I sued the officers and the police department for racketeering and violation of my constitutional rights for violating my 4th amendment right. I knew for a fact the magistrate judge would throw my case out but she also threw there case out. I didn't have to pay no fees and my car was given back to me. My father went and got it.
