As stated before, you're confusing a fact (is) with an ought (value). What people do is subject to change. What people ought to do is not.

Lock him up to keep him from killing again.and let's say the man that was killed was a bum that has no family or friends. Why should that man be punished for killing that bum? The bum no longer exists and cannot experience anything. He had no friends or family so there aren't any grievances. There are no negative burdens held.
Punishing that person would only put a faith in perhaps a karma based system or afterlife but those haven't been proven.
