Cops have authorization to use force to stop suspects from fleeing, though not unilaterally. All it takes is a reinterpretation that he thought someone who has proven themselves worthy of fleeing continuing to run and fighting the cop as needing to be "stopped." He could say he thought the Scott had something on him and that'd be that.
