if anything i bet most folks who interact with him don't even view him as black. i'm sure white cops let him move along like a white man. and many light skin blacks benefit from this as well. i agree with your first point. but this second one is basura. when you walk down the street, people don't treat you as black cause you got a sign over your head saying "black man right here." they treat you black cause you look black. this dude at certain angles might look black. at others white. so I doubt it even comes up much with him anyway.
