It's up in the air IMO. Yes he may know Kak so Obito automatically comes to mind but they were kids so why talk greasy like that? And the Gai comment is just him knowing events thru Zetsu...Gai fighting Kisame and not remembering who he was.

So why didn't this nikka just get Kabuto to summon the two brothers and take their nine tails chakra instead of going through an all out battle?

Kabuto didn't trust Tobi, so obvious he didn't want Tobi to get more powerful. And you do know infinite tsukuyomi would affect Kabuto too, so that tells you he wasn't stupid enough to give them to him.

The version he's about to summon is incomplete. It has enough chakra to summon ten tails. But he won't be at full power.
