if there were 12 jurors, then he is up for death, if it is less than that then he cant get death. in the original trial, they chose not to seek it. i dont know how many jurors were on this one, though...

so according to this article, they just retried the same case so even with more jurors it is a life in prison case only...i guess they cant change it for a retrial?
