You never know someones intentions so from the perspective of the father, id have pursued the vehicle gun in hand.

As for the thief, if he was looking for a simple come up and didn't know there was kids in the car, soon as he jumped in he knew shyt just escalated 10 fold. fukk, can you image that feeling?

If anyone should be charged its the bystanders. The father has the right to protect his children and property. The strangers are the ones who made this an excessive force situation. In most states once someone is subdued you don't have the right to continue using force on them. Sounds like he was jumped to death but oh well, still his own fault.

Yeah the bystanders who joined in should be charged. Not so sure about the father.

This. How would the bystanders know that the father was the father? Maybe he was a crazy guy running up on a father with kids in the car? No way to know for sure until all the facts come out. Definitely not enough info to participate in a beatdown that turns into a homicide.
