To avert a lengthy court process that could potentially be appealed to the Supreme Court and jeopardize other social justice government programs like affirmative action, the legislative fix currently underway is to amend the Emergency Relief for Farmers of Color Act within the Build Back Better plan to include debt cancellation for “at risk” and “socially distressed” farmers, explains Stephen Carpenter. Carpenter is the deputy director and senior staff attorney at Minnesota-based Farmers’ Legal Action Group, a nonprofit law center that supports family farmers and receives substantial financial support from country singer and farmer advocate Willie Nelson.

However, with the Build Back Better plan dead in the water at this point, and no indication that even a “skinny BBB” will pass, Carpenter says the debt relief is frozen in place. If Miller’s lawsuit is “left to play itself out in the courts, the fastest imaginable result is many months.”
When the American Rescue Plan Act was signed on March 11, 2021, an estimated 16,000 farmers and ranchers of color were informed by the USDA’s Farm Service Agency that their direct and guaranteed loans were fully forgiven.

Included within ARPA, $4 billion was allocated to the Emergency Relief for Farmers of Color Act, a program intended to address the “cumulative effects of discrimination among socially disadvantaged producers,” defined as American Indians, Alaskan natives, Asians, Blacks, Pacific Islanders and Hispanics.


In an explanation of the debt relief, the U.S. Department of Agriculture acknowledges its history of systemic discrimination toward these producers, which was “sometimes overt and sometimes through deeply embedded rules and policies” since its founding in 1862. The loans were intended to be canceled at the rate of 120% to cover tax liabilities and other associated debt payment fees, and the payments were meant to “begin a new era of building trust” between the USDA and socially disadvantaged producers.

In April 2021, along with a bevy of other lawsuits across the nation, Texas Agricultural Commissioner Sid Miller filed a class-action lawsuit to halt the payments, claiming the debt relief is unconstitutional because it discriminates on the basis of race, excluding white farmers.


The lawsuit has left many farmers of color in the lurch, particularly in Texas.

FEDERAL JUDGES were striking it down after white farmers challenged it. At 7:00 he himself mentions Biden tried to get something going and it got blocked.

Yesterday we had a giant thread on black federal judges being put in and guess what? Bunch of folks act like it is no big deal. Then, instead of complaining about the lawsuits blocking the inclusion of relief for black farmers, he goes on a "Will Democrats do anything for black people?" Instead of educating his viewership about the importance of representation in the judiciary, this happens.

This is what I am talking about: white supremacists can block everything and Democrats get blamed. These matters are still in the courts.

Every time he appoints a black judge, you damn MAGA shilling "Trump is my dad" c00ns say its just symbolism and tokenism when brehs have been trying to get y’all to see that this is the exact reason why black judges are necessary. Trump appointed MAGA judges and those racist devils are doing their best to keep that money from getting to black farmers. There's nothing Joe can do besides letting it go through the court system.

We call upon our fellow farmers, neighbors and friends to join John Boyd in his call for President Joe Biden to issue a Farm Foreclosure Moratorium to save American Farmers. The Biden Mortgage Moratorium must include foreclosure protection for USDA Farm Service Agency (FSA) Farm Ownership Direct and Guaranteed Loans as other Agricultural Loans while legislative remedies are being debated in Congress.
America's Farmers are worth saving!

That might actually be a thing worth doing. We have to watch the Supreme Court though. They already struck sort of a blow to agencies and this very well could also be something that gets scrutinized later. Losing the Supreme Court fukked so many things that its hard to know what well-meaning policy from agencies will make it.

Did you read it my guy? Provisions to get black farmers relief is tied up in the courts. What does a judicial process have to do with the Democrats?
