MANSLAUGHTER is the intentional killing of another human being without premeditation or malice. This is a distinct crime from murder, but carries serious consequences such as life imprisonment. Manslaughter can be voluntary if the actions were committed with the intent to kill, or can be involuntary. However, deliberation and premeditation are elements of MURDER, not Mansluaghter.

They can’t prove he meant to kill him based on that video and what we heard they would lose. Meanwhile props to them for not going for negligent homicide which would be he easier one to prove but only has a 1-4 year sentence maximum. This is going to be a high profile case and outside money through either rich donors or gofundme is going to get Penny a great lawyer. The DA is going to have go out there an show he fukked up royally doing a 15 chokehold because he should have known that would kill someone and hope the jury holds him accountable.

The eye witnesses have already gone on the record saying they didn’t think Neely would die but your going to prove to a jury that Penny meant to kill him?

I’d say involuntary manslaughter is way easier to convict. Overcharging is how the cops in the Freddie Gibbs case got off. They were charged with 1st degree murder.

Former U.S. Marine Daniel Penny surrenders to the NYPD for the death of Jordan Neely in New York City
(Reuters) - A former U.S. Marine who killed a homeless man by putting him in a chokehold on the New York City subway was taken into custody on Friday and expected to be arraigned on a manslaughter charge, CNN reported.
A viral video showed the former Marine, identified as Daniel Penny, putting 30-year-old Jordan Neely in a chokehold on May 1 while they rode on the F train in Manhattan. Neely died from a compression of the neck, the medical examiner said, but Penny's lawyers said he did not mean to kill him.
According to witnesses, Neely, who was known to impersonate Michael Jackson in the subway system, was complaining loudly about being hungry and saying he was ready to die when Penny came up behind him and gripped him around the neck. Penny restrained him on the floor of the subway car until he appeared to stop moving. Neely was later declared dead.

Penny, 24, surrendered to police on Friday to face one count of second-degree manslaughter, CNN reported. He is to be arraigned in Manhattan Criminal Court, the Manhattan District Attorney Alvin Bragg said on Thursday.

A bystander's video of Neely's death garnered national attention and revived a debate among New Yorkers about crime in the subway and what to do with a growing number of homeless people in the city.

Second-degree murder refers to acts of intentional killing of another person that is not premeditated, such as killing someone during a fight. You can still receive a long prison sentence for second-degree murder, but these cases usually do not involve malice.
