This is not on the DA. At least not on how he charged him. The prosecutors may have fukked up during jury selection, I don't know. But with several fellow riders saying they "felt threatened", 2nd degree murder was likely not going to work. Let's be honest - if you can't get Manslaughter or even Criminally Negligent Homicide, that jury is not convicting on Murder. this was ALL ON THAT JURY. The facts were clear. A VIDEO was shown showing dude still choking him while he's kicking and struggling to breathe even after EVERYONE HAD LEFT except for the other two dudes HOLDING HIM and they STILL let him walk. Sometimes the evidence speaks for itself, It's not always the DA's fault.
This is on the jury. They didn't see this mans life as having value.
