News 4 Investigates: Ferguson Municipal Court

(KMOV.com) – Ferguson’s Municipal Court has been under fire for being used as a huge revenue generator for the city.

In 2013, Ferguson collected $2.6 million in fines and fees, making it the city’s second biggest source of revenue. A judge said the court has made some changes, such as getting rid of some fees and automatic arrest warrants for those who fail to show up to court for minor cases such as traffic offenses.

The docket is dominated by traffic violations and minor drug cases. Cases can include a half dozen citations for one traffic stop, which can quickly add up to thousands of dollars in fines for some defendants who often fail to appear in court because they fall behind on their bills. Those defendants then have warrants issued for their arrest.

“A person can’t afford it,” said Larron Leydin, who had the same thing happen to him.

In 2013, Ferguson issued around 33,000 warrants for non-violent warrants. Only 21,000 people live there.

When News 4 went to visit the Ferguson Municipal Court, reporter Craig Cheatham noticed all 17 court employees were white, a figure that includes the judge, prosecutors, police, and clerks. Nearly 9 out of 10 defendants were African American.

“I think it sends a bad signal,” said Ferguson Municipal Judge Ron Brockmeyer. Brockymeyer is also a judge in Breckenridge Hills and a prosecutor in Florissant, Dellwood, and Vinita Park.

A report released by Arch City Defenders, a public defender group, said municipal courts in Ferguson, Florissant, and Bel-Ridge consistently violate the rights of the poor and undermine public confidence in the judicial system.

15 of the Top US Neighborhoods with the Most Black Residents

The Higley 1000 list calculates the top neighborhoods in America based on U.S. census data and other surveys. According to the site: “[The] methodology consisted of aggregating contiguous block groups with a mean income over $200,000. Block groups are subdivisions of Census tracts.”

Also noted by the list aggregators is that Black people continue to lag behind other ethnic groups, making up just 1.7 percent of the population of the top 1,000 neighborhoods.

Pathologist who did private autopsy questions finding of gun residue on Michael Brown

Dr. Mary Case, the St. Louis County medical examiner, said Thursday through a spokeswoman that her office is confident of an autopsy finding that material consistent with gunshot residue was on Michael Brown's right thumb.

A private forensic pathologist consulting for Brown's family, Dr. Michael Baden, was quoted by USA Today as questioning that conclusion, asking for additional materials and offering to provide his analysis to a grand jury investigating the death.

Case's spokeswoman said, "We stand by our report, and we are following our process. I have nothing more to say at this time."

A new study suggests that aggressive policing likely has an adverse effect on the mental health of young men in New York City -- particularly young men who are black.

The study, released Thursday by the American Journal of Public Health, appears to show higher rates of feelings of stress, anxiety and trauma in young men who experienced multiple or intrusive stop and frisk encounters with police than among young men who had fewer or no such encounters.

"Our findings suggest that proactive policing tactics have the potential to negatively impact the relationship between the community and police, as well as the mental health and well-being of community members," Amanda Geller, a professor at New York University and lead author of the study, said in a statement."

WASHINGTON — St. Louis County Prosecuting Attorney Robert McCulloch stated definitively on Thursday that a Twitter account claiming inside knowledge of the grand jury deliberating whether to charge the police officer who killed Michael Brown “had, indeed, been hacked.” But a spokesman for McCulloch revealed that his conclusion was based solely on an interview with the St. Louis County woman associated with the account and a search of her computer.

Susan M. Nichols had operated a Twitter account under the name @thesusannichols. In early October, a tweet sent from the account indicated that the user knew “someone sitting on the grand jury of this case” and that there wasn’t enough evidence to charge Ferguson, Missouri, Police Officer Darren Wilson in Brown’s death

McCulloch said after the possible leak that he would be “shocked if a member of the grand jury said anything.” On Thursday, he announced that his office had concluded that the account was hacked “and the origin/author of the tweet is unknown.”

McCulloch spokesman Ed Magee told The Huffington Post that Nichols had voluntarily spoken with investigators and never went under oath. While Nichols also allowed investigators to look at her computer, they did not examine her cell phone or any other electronic devices she might own, Magee said.

McCulloch’s office subpoenaed Twitter for information about @thesusannichols, but the company said it didn’t have IP logs affiliated with the account, according to Magee. (Twitter’s website says some information like IP logs “may only be stored for a very brief period of time.”) Investigators did not look for information associated with @smde7763, the Twitter handle that @thesusannichols adopted shortly after attention was called to the original username, because Magee said it was “a different account.” (But the two Twitter handles have seemingly identical histories of tweets going back over a year.)
