the sampling laws are racist...... cacs got rich making covers of black music but when hip hop came all of a sudden you can't repurpose a song or sample a 3-5 second loop without giving up all your royalties. I think Russell Simmons said he was gonna take the issue to the supreme court back in the day but probably didn't want the smoke




the label is supposed to clear the samples which makes it funny that it's always the artists who get sued for it

Responses in here are typical, but understand that Sting HAD to sue. He literally had no choice.

Had Sting not sued, he would have essentially relinquished rights to his own song. It goes like this: if you don’t protect your copyrights and trademarks you lose em for all intents and purposes.

So say Sting let diddy slide. Well, if 5 other people came after and sampled ‘missing you’, and sting decided to protect it then, the judge would ask Sting, “why didn’t you sue the first time it was sampled?”. It almost becomes public domain.

No one is going to even ask why diddy didn’t bother to clear the sample? He took not only the beat, but the melody, the chorus, and the signature lyrics in the hook. That’s insane. fukk does racism have to do with puff’s arrogance and incompetence?

Puff was (still is) a sharp businessman. It's possible he didn't do the research, but it's also likely that he knew what was up and just didn't think Sting would call his bluff.

I don’t know how anyone who is a shark on Puff’s level forgets to clear a sample on one of Sting’s top 3 hits.
Three possibilities that often happened back then:

1. A DJ got his hands on it and put it on the radio as an exklusive before it could be cleared. Once it got played on the radio, the owner of the copyright can basically demand 100% publishing if you want to release it legally. - I think this is what happened with breathe.
2. The artist himself gave it to a dj to play it on the radio because he was so excited about the record, and is either inexperienced or doesn't want to wait for clearance and feels it is great promotion for his album.
3. The artist already used up the budget for his album and the record company isn't willing to put up the money to clear the record. The artist says fukk it, because he thinks it's a great record and a valuable addition to his album so he leaks it to the radio to create a buzz and force the record company to release it.

It's fukking stupid how you gonna be a so-called music producer but can't write or create music from scratch...:what: People give swizz beats alot of shyt for his corny beats but besides that whole casio debacle when he came out his shyt was more or less "Original"

There are levels to production..

For what diddy is trying to accomplish, he has an elite ear and pays attention to detail...

It's time to stop sampling and get producers that know how to play instruments and keyboards.
Hip hop was founded on dj's finding break beats in songs and rewinding it back on two turn tables. Then sampling came into play because they knew all these records and dope shyt and they also couldn't play instruments or pay anyone. Sampling is a pillar of Hip Hop or at least it was. This shyt also happen to Fabalous for the song breathe. I know theres more example can't think of them right now but this happens.

This is either false information or Puff is not as smart a music mogul as we thought. Rappers have been through this OVER AND OVER almost since the beginning of rap music. How in the world could he, Bad Boy, and Arista "forget" to clear the sample from one of the biggest songs of the modern era?

I know hip hop was based on sampling buy with the new technology and change in the culture... you'd think more producers would learn how to play instruments. In the age of streaming, it would make more sense financially to do so. The era of Just Blaze, Dj Premier etc are gone.

Hell... even Timbaland got into some shyt for sampling some Arabs for Big Pimpin without clearing it. I'm just tried of seeing black artists making retired CACs even richer and relevant. They don't even have to lift a finger anymore.
