Talk about moving through life based solely on emotion, not logic.
The kid doesn't know how to control his emotions, and if given the proper guidance, could learn how to control his emotions (that is obvious based upon him having EMPATHY as detailed within the story). I was a bad kid and if I went to jail, I am sure I would have turned out far worse instead of going to college and completing a degree in physics. He is 12-13yrs and his brain hasn't even fully developed. I say, no jail, rather rehabilitation in the form of speaking to competent psychologists and having mentors guide him. There are black mentors in just about every city that guide young black males like the kid in the story. I had one that helped me out a lot.

Unfortunately due to the circumstances, this is kind of a toss up. Clearly the kid is mentally ill, but he is old enough to know right from wrong and the value of life.
