So let's be realistic- you're more likely to rape your wife than someone else is, and your martial arts skills and your gun are potential rapist tools. Let's keep your wife safe and stop talking all this coulda-woulda-shoulda about drinking, bars and telling people no. She should be spending more time away from you. Tell her to take the seed, too, since the same is true for child sexual abuse.

More "coulda shoulda woulda" talk from you. We don't live in a fantasy world where all men won't rape if their wives are perfect. Let's stay in the real world and stick with the facts and figures we have, which all indicate that your wife is less likely to be raped if she spends less time around you, since strangers are less likely to rape her than you are. The same is true for your seed. You do want them to be safe, don't you?

Punishing the woman who was raped isn't from Sharia. The four witness bit is required to either lash the hell out of the guy or stone him to death. So these bedouin Arabs and dumb ass Pakistanis already :ufdup: there.

This is a common myth about Islamic criminal law. Rather, the four witness requirement applies only to the prescribed hadd punishment (which in the case of a married person could be death and for the non-married, 100 lashes). [Marghinani, Hidaya] This punishment is only applied in very rare cases, as is clear, and is meant to be a social deterrent, above all.

As the classical and contemporary jurists (such as Mufti Taqi Usmani) have made clear, a rapist can be convicted on lesser evidence (including scientific evidence, such as DNA tests and medical reports) for discretionary punishments. These discretionary punishments are left up to the legal system to determine.

However, it is a myth to say that Islam would in any way condone rape, or allow a rapist to go free for this terrible crime against an innocent human being and against society.


The female victim's testimony is sufficient to indicate a crime of rape when evidence contributes to this crime, such as bruises, scratches, etc.
There are numerous evidences of this when a woman reported a crime against her and the Prophet (saaw) detained, investigated, and so forth.
However whether the matter rises to zina` is another matter and discretionary punishment taazirat and mahr are deemed part of the lesser prosecution.
There are several degrees of 'rape', from mere coercion to hiraba- kidnapping, imprisonment, rape, beating, etc.
So if a perpetrator uses a weapon on a woman, beating her, shooting her, injuring her, kidnaps, imprisons and transports her elsewhere, rapes her, this could rise to the degree of hiraba which is the more severe crime, likely warranting a death sentence.

An event concerning rape had in fact led towards the Prophet Muhammad (P) punishing a rapist without demanding or even hinting for four witnesses:
“Narrated Wa’il ibn Hujr: “When a woman went out in the time of the Prophet (P) for prayer, a man attacked her and overpowered [raped] her. She shouted and he went off, and when a man came by, she said: That [man] did such and such to me. And when a company of the Emigrants came by, she said: That man did such and such to me. They went and seized the man whom they thought had had intercourse with her and brought him to her.

She said: Yes, this is he. Then they brought him to the Apostle of Allah (P).





When he [the Prophet] was about to pass sentence, the man who [actually] had assaulted her stood up and said: Apostle of Allah, I am the man who did it to her.

He [the Prophet] said to her: Go away, for Allah has forgiven you. But he told the man some good words [Abu Dawud said: "meaning the man who was seized"], and of the man who had had intercourse with her, he said: “Stone him to death.“

Many Muslim scholars use this ayah for rape and other crimes. Rape constitutes fasaad.


“The recompense of those who wage war against Allaah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off from opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter”
