What can we do? How can we change this crooked devious system and please don't talk about voting. WHAT CAN WE DO ABOUT THIS????????? I mean this can happen to any of us, we need solutions.
There's only one solution. Every other option merely prolongs our suffering as a community. We need to get on code and fight back. :francis:

Malicious intent or premeditation

Yep so if she was charged with murder then the chances of her being let loose would be higher because there's been no evidence brought to the forefront to say that she did it with malice. It's a fukked up situation but that's just the world we live in.

Manslaughter is not intended. Murder is premeditated.

Watch her get off with the minimum 2 years if convicted.

Nah. Texas statute says:

A person commits [murder] if he:

(1) intentionally or knowingly causes the death of an individual;

(2) intends to cause serious bodily injury and commits an act clearly dangerous to human life that causes the death of an individual[.]

PENAL CODE CHAPTER 19. CRIMINAL HOMICIDE

It was murder and she is going to get away with it. I hope the toxicology report shows how drunk she was because then they'll upgrade the charges to 2nd degree murder.

Someone tell me what's the difference between a manslaughter and a murder charge.

She should be charged with murder since she pulled a trigger with intent to shoot. Initially murder charge but given the opportunity to plead down to manslaughter in trial. There and three degrees of murder severity. Manslaughter is for accidents. But this is definitely murder. If she was too tired to find her appt how was she not too tired to aim and pull the trigger?

If they charge her with murder she may end up getting off. If the story is that she went to the wrong apartment then they gotta charge her with manslaughter if they want her to serve any time at all.

You'd have to prove that she knowingly went to the wrong apartment with the intent to kill this dude for a murder charge to stick.

If her argument is that she was tired and ending up at his apartment was an accident, a manslaughter charge would be a more viable option.

I think the reason the judge wouldn't sign a warrant unless it was for murder was a trap cause then the prosecutors would have a difficult time proving that her actions were premeditated.

Murder is when you have the intent to kill and you do it.

Manslaughter is when it was an accident.

For example, if you grab your gun and kill someone for fukking your girl, that's murder. If you get into a fight with someone and he falls, hits his head and dies, that's manslaughter.

SHE SHOT HIM WITH THE INTENT TO KILL
SHE DIDNT SHOOT HIM BY ACCIDENT.
