It's not even just for people.
If I went on my FB account and said fukk <my company name> and one of my co-workers(they are on my friends list) reported it to HR, I'd have to deal with
1.) Get some type of warning
2.) Terminated.
The message could be considered private( private as in being to only people on my list etc.).

its called freedom of speech.
He's not getting prosecuted for saying this. That's what the first amendment does, protect him from government prosecution. Doesn't prevent your employer from taking action for what you say or do.
