At the end of the day him being in the open construction house is NOT considered illegal in Georgia...
The timing of things dosen't support that narrative unless the two men chased him in their truck for half an hour before stopping in front of him. First 911 call was at 13:08 when he left the house he shouldn't have been in. The two men charged with his murder called 911 at if memory serves about 13:13 saying they were following someone they believed was responsible for previous burglaries. Police arrived on scene to the shooting at 13:46, aver a half hour after he trespassed. I've not seen a specific time anywhere for when the shots were fired but I doubt it took officers half an hour to arrive on scene to a shots fired call with suspect bleeding on the ground call. From the initial police report the man who shot him claimed he recognized him as he walked down the street from previous burglaries in the neighborhood. But never mentioned anything about seeing him burglarizing a house that day, unless you believe the officer never reported that detail.
Though it's a bit arbitrary as by
Georgia law they had no right to make a citizen arrest, let alone an armed arrest, based on what happened. First he hadn't committed a felony, he had trespassed in an unsecured building and did no damage nor did he steal anything.
Going by the letter of the law, and assuming that no shots had been fired that day but the shotgun was still used to stop him it would have been a weird awkward day for the officer's responding. They would be charging the man with the shotgun for
brandishing and likely letting Ahmaud Arbey go since I don't think he actually nailed the requirements for
Geogias trespassing law. Hopefully some officer from Georgia can clarify but the way I read it, given that he didn't commit a crime while on the property nor was told to leave. So when you add in that the guy did shoot him I gotta say I hope they both get convicted for what they did. Two wrongs never make a right.
BTW, the idea that Arbery circled around the truck to get to the man who killed him makes no fukking god damn sense what so fukking ever. It pisses me off to no end that people keep saying this. He was on the drivers side before detouring to around the truck and the most direct path to the man he's supposed to have "gone after" would have been to not detour around the truck. While I'll admit I'm making an assumption here I'm firm in my belief he was trying to avoid the man and when the man made a move to intercept him Arbery decided he didn't want to get shot in the back so he went for the man's weapon. That's much more sensible than imagining he rant the longest route possible to jump the guy with the shotgun.
