This is what happens when cats try to apply real life logic to fiction. It never works. A shape-shifter would be nonbinary....really, the only truly nonbinary person in existence, because they're both/neither genders.
This is like when people got upset at Loki for being bisexual. Dude changes into women, of course he is. I never considered him not bisexual.
